These Terms form a legally binding agreement between you (“you” or “user”) and PrivacyPros. By accessing or using the Website, including browsing, registering, or purchasing products or services (“Products” or “Services”), you agree to these Terms. If you do not agree, you must not use the Website.
  2. We may update these Terms at any time by posting changes on the Website. Changes take effect immediately. Your continued use constitutes acceptance.

2. Eligibility and Acceptance

  1. You must be at least 18 years old or have parental/guardian consent to use the Website. By using the Website, you confirm you meet this requirement and agree to these Terms.
  2. For purchases, you accept these Terms by proceeding to checkout or completing payment.

3. Definitions

  1. For the purposes of these Terms and Conditions:
    1. Country refers to Australia.
    2. Goods refer to the items offered for sale on the Service, including privacy phones, laptops, accessories, and related products.
    3. Orders mean a request by you to purchase Goods or Services from us.
    4. PrivacyPros (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to PrivacyPros Pty Ltd (ACN: 692728082).
    5. Service refers to the Website, including products (e.g., customised privacy devices and accessories), services (e.g., digital footprint audits, consultations, community education), and any related tools or features.
    6. Services refer to non-physical offerings such as audits, consultations, and community engagement activities provided by us.
    7. Website refers to PrivacyPros, accessible from https://privacypros.com.au.
    8. You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable

4. General Conditions

  1. You agree to provide current, complete and accurate information for all purchases made at our Website store.
  2. You use the Website only for lawful purposes and in compliance with Australian laws.
  3. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
  4. You must not engage in unauthorised activities, such as scraping data, infringing IP, or disrupting the Website.
  5. We reserve the right to refuse service to anyone for any reason at any time.
  6. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. If we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.
  7. Violations of these terms may result in immediate account termination, legal action, and claims for damages, with PrivacyPros reserving the right to pursue civil and criminal remedies.

5. Products, Services, and Purchases

  1. Certain products or services are subject to return or exchange only according to our Warranty, Returns & Cancellations section below.
  2. We have made every effort to display as accurately as possible on the website the colours and images of our products. We cannot guarantee that your computer monitor’s display of any colour will be accurate.
  3. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
  4. Prices are in AUD, inclusive of GST where applicable, and subject to change without notice.
  5. For Privacy Phones – you will be receiving an open box product. We purchase all phones brand new from our Australian suppliers, then open the box to physically access the device to provide the service of configuration
  6. For Privacy Laptops – you will be receiving an open box product. We purchase these laptops either brand new or refurbished from our Australian suppliers, then open the box to physically access the device to provide the service of configuration. Whether a device is brand new or refurbished will be explicitly stated in the product description.
  7. For Accessories – We purchase all accessories as brand new from our Australian or overseas suppliers
  8. We reserve the right to refuse or cancel orders (e.g., due to errors or stock issues).
  9. We reserve the right to limit the quantities of any products or services that we offer.
  10. To purchase:
    1. Select items and proceed to checkout.
    2. Provide accurate payment and delivery details.
    3. Payments are processed via secure gateways (e.g., Stripe). You agree to their terms.

6. Delivery

  1. After your payment is authorised and verified, all orders are processed within 2-15 business days. We will contact you if, for some reason, there are any delays.
  2. We prioritise efficient and discreet shipping to ensure your privacy-focused devices arrive securely and promptly. While our inventory is dynamic and subject to fluctuations, orders are processed within 2-15 business days from order confirmation and payment receipt, and 2-5 days for delivery. In rare cases, such as when awaiting new shipments from suppliers or delays with postal services, it may take longer. If we foresee or advised on any delay, we’ll proactively reach to you to keep you informed and discuss options.
  3. All packages are shipped via Australia Post.
  4. Delivery times are estimates; we are not liable for delays.
  5. If purchased item/s are lost or damaged during the Delivery Services, we ask that you contact us so we can investigate the matter with the Delivery Service Provider directly. We handle these matters on a case-by-case basis while maintaining our ACL obligations.
  6. We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, pandemics).

7. Warranty, Returns & Cancellations

Warranty

  1. For physical products we supply, such as privacy phones, privacy laptops and accessories, we purchase through official distribution channels in Australia and overseas. Warranty does not cover:
    1. Deliberate or Accidental Abuse or Misuse Damage
    2. Cosmetic Damage (e.g. scratches, dents)
    3. Excessive force or improper use
    4. Water, Liquid damage
    5. General Wear and Tear
    6. Unauthorised Repairs
  2. Privacy Phones  – come with 2 years OEM (Original Equipment Manufacturer) warranty. OEM warranty typically covers manufacturing defects (e.g., battery, screen, hardware failures) and remains valid in Australia. Installing alternative operating systems does not void it, as Google supports alternatives on their Pixel mobile devices. Handle claims by contacting us at https://privacypros.com.au/contact with the inquiry type ‘Warranty, Returns & Cancellations’. Upon verification of your order, we will provide instructions for you to return the product to us including its original packaging and proof of purchase so we can contact the supplier to pursue a claim. The return postage and handling fees for warranty claims are at your expense. The outcome of the warranty claim will be provided to you and we will contact you to discuss repair/replacement/other options.
  3. Privacy Laptops  – come with 12 months return to base warranty unless stated otherwise. The warranty period begins from the date of our purchase. Handle claims by contacting us at https://privacypros.com.au/contact with inquiry type ‘Warranty, Returns & Cancellations’. Upon verification of your order, we will provide instructions for you to return the product to us including its original packaging and proof of purchase so we can contact the supplier to pursue a claim. The return postage and handling fees for warranty claims are at your expense. The outcome of the warranty claim will be provided to you and we will contact you to discuss repair/replacement/other options.
  4. Accessories – come with their individual warranty that is described in their Product Descriptions found on their product page.

Returns

  1. As our Privacy Phones and Privacy Laptops are custom-hardened privacy devices, returns align with Australian Consumer Law (ACL) for non-standard goods – remedies focus on faults, not change-of-mind. We disclose this upfront to sustain our model and we are unable to accept return of products for change of mind.
    1. For the purposes of this clause, ‘custom-hardened privacy devices’ refers to Privacy Phones and Privacy Laptops that have undergone specific technical modifications including alternative operating system installation and security configurations. These software modifications do not void the OEM hardware warranty for manufacturing defects.
  2. For accessories we accept change of mind returns if they meet all the following criteria:
    1. Returned within 14 days from the day of delivery receipt
    2. With proof of purchase e.g. receipt (Bank statements are not accepted as a proof of purchase), and
    3. Item must be unused and in original packaging (e.g. sealed, Shrink Wrap).

Cancellations

  1. If we have not yet sourced your product (typically within 2 business days from placement of your order) a full refund for the product and postage can be provided at our discretion.
  2. Consumers have additional rights under the ACL that cannot be excluded. For more on ACL: https://accc.gov.au/consumers.

8. Accuracy, Completeness and Timeliness of Information

  1. We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting primary or more accurate sources of information. Reliance on the material on this site is at your own risk.

9. Optional Tools / Third-Party Links

  1. We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
  2. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
  3. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
  4. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
  5. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third- party websites. Please review carefully the third-party’s policies and practices and make sure you understand them before you engage in any transaction.
  6. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

10. Limitation of Liability

  1. To the maximum extent permitted by law, we are not liable for indirect, consequential, or special losses (e.g., data loss, business interruption) arising from use of the Website, Goods, or Services.
  2. Nothing in these Terms excludes or limits our liability for:
    1. Fraud or fraudulent misrepresentation;
    2. Breach of non-excludable ACL guarantees (e.g., for major failures, remedies include refund/replacement without cap); or
    3. Any other liability that cannot be excluded by law.
  3. For other claims (e.g., minor breaches), our liability is limited to resupplying the Goods/Services or paying the cost of resupply.
  4. You indemnify us against claims arising from your willful or negligent misuse of the Website, Goods, or Services, including breaches of law. We mutually agree to indemnify you for our willful breaches causing you direct loss.

11. InIndemnities

  1. You indemnify PrivacyPros and its affiliates against all claims, losses, damages, costs, and expenses (including legal fees) arising from your willful or negligent misuse of the Website, Goods, or Services, or any breach of laws or these Terms. We indemnify you for direct losses from our willful breaches of these Terms causing you harm, subject to clause 11(c).
  1. You must not use the Website, Goods, or Services for illegal purposes, including violations of Australian laws like the Privacy Act 1988 (Cth) or Competition and Consumer Act 2010 (Cth). Misuse may lead to termination of access/Services and reporting to authorities.

To the extent permitted by law (including Australian Consumer Law), we exclude liability for indirect, consequential, or punitive losses (e.g., lost data or profits) from use of the Website, Goods, or Services. This does not limit our liability for death, injury, fraud, or consumer guarantees under Schedule 2 of the Competition and Consumer Act 2010 (Cth).

11. InIndemnities

You indemnify PrivacyPros and its affiliates against all claims, losses, damages, costs, and expenses (including legal fees) arising from your willful or negligent misuse of the Website, Goods, or Services, or any breach of laws or these Terms. We indemnify you for direct losses from our willful breaches of these Terms causing you harm, subject to clause 11(c).
  2. You must not use the Website, Goods, or Services for illegal purposes, including violations of Australian laws like the Privacy Act 1988 (Cth) or Competition and Consumer Act 2010 (Cth). Misuse may lead to termination of access/Services and reporting to authorities.
  3. 12. Intellectual Property

You may view/download/print for personal, non-commercial use only, without modification or removal of notices. No reproduction, distribution, or commercial use without our written consent.
  2. Submitting user-generated content (e.g., feedback/reviews) grants us a perpetual, royalty-free, worldwide, non-exclusive license to use, modify, and distribute it for business purposes.
  3. Our Goods incorporate open-source software (e.g., GrapheneOS, Linux). Use is subject to relevant licenses (e.g., GPL/Apache), which may require source code disclosure for modifications/distributions. No additional warranties beyond those licenses; you must comply.

13. Privacy

  1. Your personal information is handled per our Privacy Policy (linked on the Website). By using the Website, you consent to such handling.

14. Governing Law and Dispute Resolution

  1. These Terms are governed by New South Wales, Australia laws. Disputes must first be resolved via good-faith negotiation (without prejudice); if unresolved within 30 days, submit to courts in Sydney, NSW, or arbitration if mutually agreed.
  2. All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as “without prejudice” negotiations for the purpose of applicable laws of evidence.

15. Miscellaneous

  1. If any provision is invalid, the remainder remains enforceable. These Terms constitute the entire agreement, superseding prior understandings. Waivers must be in writing.
